Model Notice for Health Insurance Marketplace Coverage
Employers are required to provide a written notice to each employee about the Health Insurance Marketplace per the Affordable Care Act (ACA). Model notices are provided by the Department of Labor (DOL) for both employers that offer a health plan and employers that do not offer a health plan.
Each model notice provides an OMB expiration date at the top right corner, which creates confusion on whether the form can still be used once expired. It is important to note that employers can continue to use the model notice even if the OMB approval number has expired.
For reference, the OMB expiration date does not apply to the form – it applies only to the OMB approval. Even though the OMB approval has expired, the form can still be used. In some instances an agency has actually already secured an updated OMB approval, but has not updated the form with the new OMB approval expiration.
As referenced in the model notice, employers covered by the Fair Labor Standards Act must inform their employees the following:
- Information about the Health Insurance Marketplace;
- That employees may be able to get lower cost private insurance in the Marketplace (dependent on income and employer offered coverage); and
- That employees may lose the employer contribution to their health benefits if insurance is purchased through the Marketplace.
